Misdemeanor Domestic Violence Charges Can Have Serious Consequences

Not every encounter with the police leads to a criminal conviction. South Florida Restaurant Owner Faces Misdemeanor Charges for Domestic Battery

There are two types of people in the world, the ones that complain endlessly and the ones who know that work is a vacation from your home life. A man who owns a successful restaurant with two locations in South Florida got into a heated confrontation with his wife at the couple’s home, and she called the police. When the officers arrived, they asked the spouses to tell their respective versions of the story. Except for the part where the couple was arguing in their bedroom upstairs until the wife went downstairs and called 911, their versions of events diverged.

The wife said that, while the two were arguing in the bedroom, her husband grabbed her by the neck and tried to hit her head against the wall, and then when she ran out of the room, he followed her, making verbal threats. The husband said that he did not threaten his wife or follow her out of the room; he made it sound like, when she left, he stayed quiet to de-escalate the situation, while she called the police. He said that he did not touch her at all during the confrontation, except when she lunged at him, and he grabbed her wrists to block her.

Cases like this are virtually impossible to prosecute unless the accuser agrees to testify. If the defendant’s wife agrees to testify in this case, it will likely be her word against the defendant’s, since there were no other eyewitnesses to the incident.
